DeFi: Who, what and how to regulate in a borderless, code-governed world?
Hold onto your hats, boys and girls! It’s a new world — a financial system without intermediaries, that anyone can access 24 hours a day with only a mobile phone and a wallet! As Julien Bouteloup said to me: “In DeFi, what we are building is fully decentralised technology, fully transparent, run by mathematics. No one can beat that.” He continued: “We are building on research papers, 40 years of research, fundamental research, discrete mathematics being built and put on-chain that no one can beat. You cannot beat that. GitHub didn't exist in the ‘90s. First, the fact that we're …

Bank of Russia wants to block ‘emotional’ and suspicious crypto activity
As cryptocurrency investments get more popular in Russia, the country’s central bank is actively working to curb perceived suspicious crypto activity as well as block some crypto purchases. The Bank of Russia has started working with local banks to make them halt payments to cryptocurrency exchanges in order to protect customers from “emotional” purchases of crypto. Sergey Shvetsov, the first deputy governor at the Bank of Russia, argued that the new measures aim to protect Russian investors from potential losses in case the cryptocurrency market “crashes to zero,” local news agency RIA Novosti reported Wednesday. The latest anti-crypto move comes …

The new episode of crypto regulation: The Empire Strikes Back
The latest news has left the decentralized finance community in a collective fetal position. Responding to the threat of increased regulatory oversight, leading decentralized exchange Uniswap recently restricted the trading of certain tokens. Earlier in July, Dan M. Berkovitz, chairman of the Commodity Futures Trading Commission (CFTC), said that DeFi derivatives platforms might contravene the Commodity Exchange Act (CEA): “Not only do I think that unlicensed DeFi markets for derivative instruments are a bad idea, but I also do not see how they are legal under the CEA.” Most worrisome of all is the initial version of the United States …

The new compliance effort has launched with support from major blockchain analytics firms, such as Chainalysis and Elliptic, among its 15 initial members. Cardano Foundation partners with Coinfirm for FATF and 6AMLD compliance
The nonprofit organization behind Cardano has partnered with blockchain analytics provider Coinfirm to ensure ADA is in compliance with the Financial Action Task Force’s guidelines. In a Tuesday announcement, the Cardano Foundation said it would be using Coinfirm’s services to provide Anti-Money Laundering (AML) and Combating the Financing of Terrorism (CFT) analytics for Cardano’s native cryptocurrency, ADA. According to the foundation, the integration will allow the project to be “in full compliance” with the guidelines set forth by the Financial Action Task Force, the European Union’s Sixth Anti-Money Laundering Directive, or 6AMLD, and other regulations applicable to Cardano. “AML/CFT analytics …

DeFi regulation must not kill the values behind decentralization
Cryptocurrency brought us peer-to-peer payments that continue to elevate participation in the global economy for millions of people without access to traditional banking services. The rise of decentralized finance (DeFi) promises to further expand access to financial services, including savings, lending, derivatives, asset management and insurance products. This innovation, which empowers financial inclusion, should be allowed to flourish in a regulated environment where individuals and institutions are protected and suspicious activity is identified and reported. But how do you regulate these decentralized products without completely removing the core attributes of financial inclusion and decentralization? Know Your Customer (KYC) procedures are …

Digital intelligence must overcome challenges to solving crypto crimes
While the value of cryptocurrencies has varied wildly in the last year, this has not diminished crypto’s attractiveness to criminals. Many of them are moving their illegal activities underground and outside the view of law enforcement. Because of the public nature of most blockchains, however, this rapid movement shouldn’t be a major concern to law enforcement agencies. With the right tools and training, following the proceeds of crypto-enabled crime is actually not as difficult as it may seem. However, intelligence agencies must have a cryptocurrency investigation plan that includes the right tools to lawfully collect digital evidence and the properly …

All Binance users are now subject to immediate KYC verification
Binance has been in the regulatory cross-hairs of jurisdictions across the globe amid claims of it operating unlicensed businesses. As remediation of the ongoing scrutiny, the crypto exchange has publicly announced new Know Your Customer (KYC) requirements for all users on the platform. “Effective immediately, all new users are required to complete Intermediate Verification to access Binance products and service offerings, including cryptocurrency deposits, trades and withdrawals,” a statement said. Moreover, existing users who were previously allowed to trade cryptocurrency without verification will be allowed to only process “withdrawals, order cancellation, position close, and redemption.” According to Binance, the change …

Outwitting crypto criminals: Why exchanges have to go the extra mile
Crypto criminals are getting more adaptive and smarter than ever before. But how can industry service providers keep up with them? If I say that the crypto industry is highly targeted by cybercriminals and, in particular, organized criminals, I’m sure that no one who has spent a few months within the space would be surprised. And for a valid reason. Due to the new technology and the nascent nature of the sector, criminals and fraudsters have long identified the excellent opportunity that crypto offers to profit via illicit methods. Indeed, any “new” approach to the financial sector is welcomed by …

South Korea’s crypto regulation is now expanding to foreign businesses
Due to their anonymity or pseudonymity, digital assets are perceived as entailing the risks of money laundering and financing terrorism. In October 2018, the Financial Action Task Force (FATF) adopted changes to its recommendations on financial activities involving digital assets, adding the definitions “virtual asset” (VA) and “virtual asset service provider” (VASP). Since then, the FATF has adopted a risk-based approach to VA activities or operations and VASPs. This new approach includes the supervision of VASPs to ensure compliance in the areas of licensing and registration and preventive measures such as customer due diligence, transaction reporting and record-keeping. It also …
