Visa abandons $5.3B Plaid acquisition in the face of DoJ antitrust suit
The United States Department of Justice saw a victory in a major fintech acquisition case that could set the stage for a host of antitrust enforcements. On Tuesday, the DoJ announced that Visa and Plaid had called it quits on their planned merger. Originally announced almost exactly a year ago, Visa was planning to pay $5.3 billion for the upstart tech firm. Plaid's ubiquitous software is designed to connect disparate systems of financial data securely. In its November 2020 complaint, the DoJ alleged that Visa was using the acquisition to snuff out competition. Today, Makan Delrahim, of the DoJ's antitrust …

Seven times that US regulators stepped into crypto in 2020
As digital assets made strides toward mainstream status in 2020, the guardians of the incumbent financial system have been working hard to minimize disruption caused by their integration. In the U.S., regulatory and law enforcement interventions throughout the year have left some projects out of business, empowered traditional players to take a closer look at crypto, and sent some unequivocal messages to cryptocurrency service providers globally. Naturally, the steady legitimization and expansion of the crypto space led regulators to get more involved than ever before. Below are the biggest cases of U.S. watchdog and law enforcement agencies’ involvement that have …

FBI to reform virtual currency practices following DoJ recommendations
A recently released U.S. Department of Justice audit of the Federal Bureau of Investigation’s (FBI) practices in regards to darknet criminal investigations concluded that the law enforcement agency is in disarray — and an overarching "cryptocurrency support strategy" might be among the solutions. According to an unclassified version of the audit released on Thursday, the FBI’s current darknet investigation efforts are — perhaps ironically — hampered by a “decentralized” set of practices, policies, and training programs, as well as compartmentalized intelligence leading to “redundant” efforts. Notably, the audit found that there are two separate Virtual Currency Teams that assist with …

This is in reference to …

The long arm of justice: How far can the DoJ really go in prosecuting foreign actors?
In early October, the U.S. Department of Justice revealed its Cryptocurrency Enforcement Framework, a report laying bare the government’s vision for emerging threats and enforcement strategies in the cryptocurrency space. The document is an important source of insight into how the laws governing digital finance will be soon implemented on the ground. One of the fundamental principles that the government asserts in the document is its broad extraterritorial jurisdiction over foreign-based actors who use virtual assets in ways that harm U.S. residents or businesses. The guidance sets an extremely low bar for perpetrators of cross-border crime to clear before they …

Justice Department files antitrust lawsuit against Visa's acquisition of Plaid
The United States Department of Justice is filing suit against Visa for its acquisition of Plaid, which the DoJ is arguing is an illegal play to achieve monopoly. According a complaint filed by the DoJ on Thursday: "Visa seeks to buy Plaid — as its CEO said — as an 'insurance policy' to neutralize a 'threat to our important US debit business.' By acquiring Plaid, Visa would eliminate a nascent competitive threat that would likely result in substantial savings and more innovative online debit services for merchants and consumers." Modern life involves a bevy of different accounts, profiles, data, etc. …
