US prosecutors seek to ban SBF from Signal after alleged witness contact
Federal prosecutors have requested that former FTX CEO Sam Bankman-Fried's (SBF) bail conditions are modified to prevent further alleged attempts at influencing witnesses’ testimonies. Court documents filed on Jan. 27 revealed that The Department of Justice (DOJ) have asked U.S. District Court Judge LewiKaplan to ban Bankman-Fried from communicating with “current or former employees” of FTX or Alameda. The prosecutors have requested this after they alleged that Bankman-Fried had reached out to Ryne Miller, the current General Counsel of FTX US, on Jan. 15 attempting to “influence” Miller’s testimony. The document stated: “I would really love to reconnect and see …

The state of Solana: will the layer-1 protocol rise again in 2023?
About two months after the FTX collapse, the Solana network is stronger than ever, according to Austin Federa, the head of strategy and communications at the Solana Foundation. Federa defines the recent SOL token price crash as a short-term market reaction to the perceived connection between Solana and the defunct crypto exchange FTX. While FTX founder Sam Bankman-Fried was invested in many Solana-based projects, Federa pointed out he didn't have any influence on the network’s operations and fundamentals. “The external perception was that there was a very close relationship between the Solana network and FTX, which wasn't the case," Federa …

The United States Securities and Exchange Commission (SEC) has been probing traditional Wall Street investment advisors that may be offering digital asset custody to its clients without the proper qualifications. A Jan. 26 Reuters report citing “three sources with knowledge of the inquiry” said the SEC’s investigation has been going on for several months already but accelerated after the collapse of crypto exchange FTX. CFTC's Johnson urges Congress for expanded powers in crypto oversight
Commodity Futures Trading Commission (CFTC) Commissioner Kristin Johnson has urged Congress to adopt legislation that "closes the current gap in the oversight of crypto spot markets." During a speech at the digital assets conference at Duke University on Jan. 21, Johnson proposed a number of amendments that would enable the CFTC to conduct “effective due diligence” on businesses, including crypto firms, that want to acquire CFTC-regulated entities. The Commissioner also wants expanded powers for the commodities regulator to enhance customer protection, prevent liquidity crises, and mitigate conflicts of interest. One of these potential changes would be to give the commodities …

Opinion: Barry Silbert keeps quiet as Genesis goes down in flames
Just two months after the collapse of FTX, Genesis is following suit. Against an increasingly disheartening backdrop of “Big Cryptos” going bust, Barry Silbert’s cryptocurrency lender, Genesis Global Holdco, is the latest firm to file for bankruptcy, and if things always come in three, it might not be the last. Genesis Capital’s parent company, Digital Currency Group, has denied any involvement in the bankruptcy filing, citing “a special committee of independent directors” in charge of the decision, seemingly without any input from Silbert himself. But both companies are already getting hit with fresh securities class-action lawsuits alleging violations of federal …

FTX legal team calls for Sam Bankman-Fried's family to answer questions under oath: Report
Lawyers representing FTX in bankruptcy court have reportedly argued that former CEO Sam Bankman-Fried’s immediate family should face questioning regarding their personal wealth. According to a Jan. 26 report from Bloomberg, FTX’s lawyers requested Judge John Dorsey in the District of Delaware allow them to question Joseph Bankman, Barbara Fried, and Gabriel Bankman-Fried — the father, mother, and brother of SBF, respectively — under oath about any financial benefits they may have received from the exchange. Other FTX executives could reportedly be subject to the same line of questioning in an effort to track down assets tied to the bankrupt …

SBF allegedly used FTX money to invest $400M in obscure VC firm
Authorities in the United States might have discovered yet another possible component of Sam Bankman-Fried’s (SBF) cryptocurrency empire. U.S. federal prosecutors have alleged that Bankman-Fried has used money from FTX exchange to invest in the venture capital firm Modulo Capital, according to a report by The New York Times. As previously reported, SBF’s hedge fund and FTX’s sister firm, Alameda Research, invested a total of $400 million in Modulo in 2022, which became one of the largest investments by SBF. The funding has drawn particular attention from regulators due to Modulo — which is a relatively unknown firm — raising …

Crypto industry leaders ‘scared of a strong SEC’ — Senator Warren
United States Senator and crypto skeptic Elizabeth Warren wants the Securities Exchange Commission (SEC) to “double down” on its crypto enforcement efforts, highlighting that the cryptocurrency industry is running “scared” for what’s to come next. Warren’s comments came from an interview with American Economic Liberties Projects on Jan. 25. The Senator opined that since Gensler was sworn in as SEC Chairman in April, 2021, the Commission “has made a good start” on fixing some of the problems created by the former SEC leaders under the Trump Administration. Warren claimed that the previous SEC administration “essentially gave the green light” to …

FTX lawyers: Examiner could cost $100M and ‘provide no benefit’
An investigation into FTX’s collapse by an examiner could cost the firm upwards of $100 million without providing any benefit to creditors or equity holders, argues lawyers representing the bankrupt crypto exchange. The arguments were part of a Jan. 25 objection to a motion from the United States Trustee in December, which called for the judge to appoint an independent examiner to ensure any investigations are transparent and their findings made public. This will be fascinating. 4 Senators submitted a letter asking for an Independent Examiner. Will they do more? Several States have entered the FTX case. Will they lend …

Crypto lawyers to be in demand as regulatory pressure reaches boiling point
Crypto-versed lawyers will play an increasingly important role in Web3 firms — particularly after the implosion of FTX and the industry braces for regulatory turbulence, two legal academics believe. Boston Law School professor and chief compliance officer at crypto exchange Bitstamp, Thomas Hook, told Cointelegraph that Web3 lawyers will soon become “business differentiators” because they’ll be faced with the tough task of helping firms navigate through legal and regulatory uncertainties. This will ultimately determine how fast firms can take their products and services to market, Hook explained: “Given the lack of clarity in many regulations and the complexity, Web3 companies …
